Olly Creative – Terms & Conditions
These Terms & Conditions (“Agreement”) outline the services and working relationship between Olly Creative (“Designer”) and the client (“Client”). By engaging in services, the Client agrees to the following terms.
1. Scope of Services
Olly Creative provides creative services including, but not limited to: branding, logo design, website design, visual marketing, photography, and content creation. The full scope of each project will be outlined and agreed upon prior to the start of work.
2. Payment Terms
A non-refundable deposit (typically 50%) is required to begin all projects.
The remaining balance is due prior to final delivery of any files or launch of services.
For larger projects, payment milestones may be established and agreed upon in advance.
Late payments may result in project delays or paused work.
3. Revisions
Each project includes a set number of revisions, defined in the project agreement.
Additional revisions beyond the agreed scope may incur extra charges.
Revisions do not include complete redesigns or changes in direction after approval of a concept.
4. Turnaround Time
Project timelines will be provided at the start of each project. Timelines may vary depending on scope, feedback, and client responsiveness. Delays in communication or content delivery from the Client may affect delivery dates.
5. Client Responsibilities
The Client agrees to provide all necessary content, feedback, and approvals in a timely manner. Olly Creative is not responsible for delays caused by incomplete or late client input.
6. Ownership & Usage Rights
Final approved designs will be delivered upon full payment.
The Client will receive rights to use the final deliverables for their intended purpose.
Olly Creative retains the right to display work in portfolios, marketing materials, and social media unless otherwise agreed in writing.
7. Intellectual Property
Any preliminary concepts, drafts, or unused designs remain the property of Olly Creative unless purchased or otherwise agreed upon.
8. Website Services
Website projects include design and development as outlined in the agreement.
Ongoing costs such as hosting, domains, and third-party subscriptions are the responsibility of the Client.
Olly Creative is not liable for third-party platform issues (e.g., Squarespace, Wix, hosting providers).
9. Photography Services
Photography sessions include agreed-upon shoot time, editing, and delivery format.
Usage rights will be defined per project (commercial, social, etc.).
Raw/unedited images are not included unless otherwise agreed.
10. Cancellations & Refunds
Deposits are non-refundable.
If a project is canceled after work has begun, the Client is responsible for payment covering work completed up to that point.
11. Limitation of Liability
Olly Creative is not liable for any indirect, incidental, or consequential damages resulting from the use or inability to use delivered materials.
12. Communication
All project communication will be conducted through agreed channels (email, phone, or messaging). Clear and timely communication ensures project success.
13. Acceptance of Terms
By proceeding with services, the Client acknowledges they have read, understood, and agreed to these Terms & Conditions.
